  1. GENERAL INFORMATION

These Terms & Conditions (“Terms”) govern your access to and use of the uNIKAtna Fitness mobile application (“App”), operated by uNIKAtna digital fitness d.o.o., Ulica Ivana Trnskoga 5, 10000 Zagreb, Croatia, OIB: 54659905787 (“Company”, “we”, “us”, or “our”).

By downloading, installing, registering for, or using the App, you agree to be legally bound by these Terms. If you do not agree, you must not use the App.

  1. DESCRIPTION OF THE APPLICATION

"uNIKAtna Fitness" is a mobile application providing online prenatal and postnatal fitness programs, including but not limited to:

  • Access to on-demand fitness video content,
  • Participation in live or recorded training sessions,
  • Personalized training planning and scheduling,
  • Communication with fitness professionals,
  • Access to content that may be free or available through paid subscriptions.

The App is distributed via the Google Play Store and Apple App Store.

  1. ELIGIBILITY AND AGE REQUIREMENT

The App is intended exclusively for users 18 years of age or older.

By using the App, you confirm that:

  • You are at least 18 years old;
  • You have the legal capacity to enter into a binding agreement;
  • You are not prohibited from using the App under applicable laws.
  1. USER ACCOUNTS AND REGISTRATION

To access certain features of the App, you must create a user account.

You agree to:

  • Provide accurate, current, and complete registration information;
  • Keep your login credentials confidential;
  • Be fully responsible for all activities conducted under your account.

We reserve the right to suspend or terminate accounts that contain false information or are used in violation of these Terms.

  1. HEALTH AND MEDICAL DISCLAIMER

The content provided through the App is for educational and fitness purposes only and does not constitute medical advice.

By using the App, you acknowledge and agree that:

  • Participation in prenatal and postnatal exercise involves inherent risks;
  • You are responsible for consulting with a qualified physician or healthcare provider before starting any exercise program, especially during or after pregnancy;
  • You use the App and perform exercises entirely at your own risk.

The Company is not responsible for any injuries, health complications, or damages resulting from participation in workouts provided through the App.

  1. SUBSCRIPTIONS, PAYMENTS, AND BILLING

Certain features and content of the App are available only through paid subscriptions and/or one time purchases.

6.1 Billing

  • On Android devices, all payments are processed through Google Play Billing.
  • On iOS devices, all payments are processed through Apple In-App Purchase services.
  • Subscription prices, billing periods, and available plans are displayed within the App before purchase.
  • Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period.
  • Your account will be charged for renewal within 24 hours prior to the end of the current subscription period.
  • You may manage or cancel your subscription at any time through your Google Play or Apple App Store account settings, depending on your device platform.

6.2 Cancellation and Refunds

  • For purchases made through Google Play, refunds are governed by Google Play refund policies.
  • For purchases made through the Apple App Store, refunds are governed by Apple Media Services Terms and Conditions and Apple refund policies.
  • The Company does not process refunds directly.
  1. INTELLECTUAL PROPERTY RIGHTS

All content, features, designs, videos, text, graphics, logos, and software associated with the App are the exclusive property of uNIKAtna digital fitness d.o.o. and are protected by copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

  1. ACCEPTABLE USE

You agree not to:

  • Use the App for unlawful purposes;
  • Copy, distribute, modify, reverse-engineer, or exploit any part of the App;
  • Interfere with the security or functionality of the App;
  • Upload or transmit harmful, offensive, or illegal content.

We reserve the right to remove content or restrict access that violates these Terms.

  1. THIRD-PARTY SERVICES

The App may integrate third-party services, including but not limited to:

  • Google Play Services
  • Firebase Analytics
  • Firebase Crashlytics

These services are governed by their own privacy policies and terms. We are not responsible for third-party data practices.

  1. PRIVACY POLICY

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal data.

By using the App, you agree to the processing of your data in accordance with our Privacy Policy.

  1. MODIFICATION OR DISCONTINUATION OF THE APP

We reserve the right to:

  • Modify, update, or remove content;
  • Change subscription plans or pricing;
  • Temporarily or permanently discontinue the App or any part of its functionality.

We shall not be liable for any such changes.

  1. TERMINATION

We may suspend or terminate your access to the App at any time, without prior notice, if:

  • You violate these Terms;
  • Your account is misused;
  • The App is discontinued.

Termination does not affect any rights or obligations accrued prior to termination.

  1. LIMITATION OF LIABILITY

The App is provided “as is” and “as available”, without warranties of any kind.

To the maximum extent permitted by law, uNIKAtna digital fitness d.o.o. shall not be liable for:

  • Personal injury or health issues;
  • Data loss or technical errors;
  • Service interruptions;
  • Indirect or consequential damages arising from use of the App.
  1. FORCE MAJEURE

We shall not be liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, technical failures, or governmental actions.

  1. CHANGES TO THESE TERMS

We may update these Terms from time to time. Updated versions will be posted within the App or on our website. Continued use of the App constitutes acceptance of the revised Terms.

  1. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Croatia.

The competent court for any disputes shall be the court in Zagreb, Croatia.
